Hayya Pay User Terms & Conditions (English Version)
By accessing and using the Hayya Pay Service (the “Service”), you confirm that you have read, understood, and agree to these User Terms & Conditions (“Terms”). These Terms govern your relationship with [Your Company Name] (“Hayya Pay”, “we”, “our”) and apply to all users. Your continued use of the Service constitutes your binding acceptance of these Terms, as amended by Hayya Pay from time to time. If you do not agree with these Terms, please do not use the Service. Any person accessing the Service using your Account is also bound by these Terms.
1. Definitions
For these Terms, the following definitions apply:
● “Account”: The unique account created with Hayya Pay during registration.
● “Account Limit”: The maximum funds allowed in your Account (e.g., RM200.00,
RM5,000.00, RM20,000.00), as determined by Hayya Pay.
● “Activation”: The point at which your Account becomes operational after successful
registration and eKYC.
● “Available Balance”: The funds in your Account available for transactions, subject to
imposed limits.
● “Bank”: The financial institution designated by Hayya Pay for processing your
transactions.
● “Customer Service Agent” (“CSA”): The support representative(s) you may contact at
[Your Support Phone Number].
● “Account Verification (eKYC)”: The electronic process used to verify your identity
during registration.
● “Device Biometrics Verification”: The use of biometric data (e.g., fingerprint or facia
recognition) from your device for authentication.
● “Face Verification”: A method of biometric authentication using facial recognition to
confirm your identity.
● “Financial Products”: Any financial products offered or facilitated through the Service.
● “Premium Products”: Additional or enhanced features provided through Hayya Pay.
● “Reload”: The process of manually adding funds to your Account via approved
channels.
● “Retail”: Transactions for purchasing goods or services using the Service.
● “Service”: The provision of the Account and facilitation of transactions via the Hayya
Pay e‑wallet application.
● “Transaction”: Any payment or transfer executed using the Service.
● “Transaction Limit”: The maximum amount allowed per transaction, as set by Hayya
Pay.
● “Working Day”: Any day other than Saturday, Sunday, or a government‑declared public
holiday.
● “Transfer”: The process of sending money from your Account to another account.
● “Request Money”: A feature that allows you to ask another user to send funds to your
Account.
● “Top Up”: The act of manually adding funds to your Account.
● “Incoming Requests”: Money requests that you receive from other users.
● “Rewards”: Incentives such as cashback, reward points, or other benefits earned
through transactions.
2. Use of the Service
2.1 Account Registration and Activation
● You must download the official Hayya Pay app, register for an Account, and complete
the eKYC process.
● Upon successful verification, you will be assigned an Account Limit based on your
profile. Hayya Pay reserves the right to adjust these limits.
● You acknowledge that Hayya Pay may use your personal data for identity verification
and ongoing service delivery.
2.2 Permitted Use
● The Service is intended exclusively for processing transactions within educational
institutions and related financial activities.
● You agree to use the Service only for lawful purposes and in compliance with all
applicable regulations.
● Any fraudulent or unauthorized use may result in immediate suspension or termination of
your Account.
2.3 Transaction Function
Your Account allows you to:
● Retail Transactions: Make payments for goods and services at educational institutions
and approved merchants.
● Reload: Manually add funds to your Account.
● PayDirect Function: Process direct payments using linked financial instruments.
● Transfer: Send money from your Account to another account.
● Request Money: Ask other users to send funds to your Account.
● Top Up: Manually increase your Account balance.
● Incoming Requests: View money requests sent to you by other users.
● Rewards: Earn incentives (e.g., cashback, reward points) through eligible transactions.
3. User Responsibilities
3.1 General Obligations
● Provide accurate and current information during registration and update it as needed.
● Maintain the confidentiality of your login credentials and notify Hayya Pay immediately of
any unauthorized access.
3.2 Prohibited Activities
You must not:
● Attempt to hack, bypass, or compromise any security features of the Service or Hayya
Pay’s systems.
● Use the Service for fraudulent, illegal, or abusive purposes.
● Access the Service using modified devices (e.g., jailbroken or rooted devices) or permit
others to use your Account.
● Engage in any activities that could compromise the security or integrity of the Service.
3.3 Account Security
● You are responsible for safeguarding your Account details. Failure to do so may result in
financial loss, for which Hayya Pay will not be liable.
● You must not share your login credentials with any third party.
4. Payment Functions and Financial Operations
4.1 Linking Financial Instruments
● You may connect your approved funding sources (credit/debit cards, bank accounts) to
your Account.
● By linking these instruments, you authorize Hayya Pay to process transactions in
accordance with these Terms.
4.2 Auto Reload and Payment Features
● Auto Reload: If enabled, your linked funding source will be automatically charged when
Your available Balance is low.
● Immediate transaction features may incur applicable fees (e.g., convenience fees) which
will be disclosed at the time of the transaction and are non‑refundable.
4.3 (RFID Functions – Removed)
5. Suspension, Termination, and Dormant Accounts
5.1 Suspension and Termination
● Hayya Pay reserves the right to suspend or terminate your Account immediately if
fraudulent, improper, or non‑compliant use is detected.
● In the event of suspension or termination, you may be required to re‑verify your identity
through the eKYC process for reactivation.
5.2 Dormant Accounts
● If no activity is detected (no transactions or logins) for 365 consecutive days, your
Account may be classified as dormant and suspended.
● Continued inactivity for an additional 180 days may result in your Account being blocked,
and any remaining funds will be processed in accordance with applicable law.
● A nominal fee may be applied for each period of inactivity and deducted from your
Available Balance.
6. Liability, Disclaimers, and Indemnification
6.1 No Warranty
● The Service is provided “as is” without any warranties, express or implied, including
guarantees of uninterrupted or error‑free access.
6.2 Limitation of Liability
● Hayya Pay’s total liability shall not exceed the fees paid (if any) or the value of your
Available Balance at the time of the claim, whichever is lower.
● We are not liable for any indirect, incidental, or consequential damages arising from your
use of the Service.
6.3 Indemnification
● You agree to indemnify and hold harmless Hayya Pay and its representatives from any
claims, damages, or expenses (including legal fees) arising from your misuse of the
Service or breach of these Terms.
7. Communications, Transaction Records, and Dispute Resolution
7.1 Reliance on Communications
● By using the Service, you authorize Hayya Pay to rely on any electronic communications
or instructions provided by you. Once authenticated, these communications are binding.
7.2 Transaction Records
● All transaction records authenticated via eKYC, biometric verification, or other secure
methods serve as conclusive evidence of those transactions.
● Hayya Pay is not obligated to reverse any authenticated transactions except as required
by law.
7.3 Access to Transaction History
● You may view your transaction history for the past 90 days through the app. It is your
responsibility to verify the accuracy of these records.
● At our discretion, physical statements for transactions not older than three (3) months
may be provided upon request.
8. General Provisions
8.1 Amendments
● Hayya Pay may modify these Terms with at least 21 days’ notice via in‑app notifications
or email. Your continued use of the Service constitutes acceptance of the updated
Terms.
8.3 Entire Agreement
● These Terms constitute the entire agreement between you and Hayya Pay regarding
your use of the Service, superseding all prior agreements.
8.4 Severability
● If any provision of these Terms is found to be invalid or unenforceable, the remaining
provisions shall continue in full force and effect.
8.5 Waiver
● Hayya Pay’s failure to enforce any provision does not constitute a waiver unless
expressly confirmed in writing.
8.6 Assignment
● You may not transfer your rights or obligations under these Terms without Hayya Pay’s
prior written consent. Hayya Pay may assign these Terms at its sole discretion.
8.7 Notices
● Hayya Pay may serve notice of any changes to these Terms via our website, mobile app, or other designated channels.
8.8 Intellectual Property
● All trademarks, logos, and proprietary rights in the Service are owned exclusively by
Hayya Pay. No rights are granted to you except as explicitly provided.
9. Anti‑Money Laundering and Regulatory Compliance
9.1 Regulatory Obligations
● Your personal data will be processed in accordance with the PDPA and all applicable
financial regulations.
● Hayya Pay maintains an anti‑money laundering and anti‑terrorism financing program as
required by law.
9.2 Suspension for Regulatory Breaches
● Any fraudulent, illegal, or suspicious activity may result in immediate suspension or termination of your Account without refund.

expressly provided herein.
11.2 Service of Notice
● Hayya Pay may serve notice under these Terms by posting on its website, mobile app, or through other channels. Notices are effective upon posting.
11.3 Binding Effect
● These Terms are binding on you and your successors and will benefit Hayya Pay’s
successors and assigns.
11.4 Force Majeure
● Hayya Pay is not liable for any failure to perform its obligations due to events beyond its
control, including natural disasters or government actions.
11.5 Assignment
● Hayya Pay may assign these Terms, in whole or in part, at its discretion.
11.7 Complaint Escalation
● Should you have any unresolved complaints, you may contact the relevant regulatory
authorities.
